1. Agreement to Terms

By accessing or using GateKeeper's CAPTCHA services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Services.

2. Description of Services

GateKeeper provides bot detection and CAPTCHA verification services including:

• Proof-of-Work challenge generation and verification
• Behavioral analysis for bot detection
• Risk scoring API
• Dashboard for site management and analytics

3. Account Registration

3.1 Account Requirements

To use our Services, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

3.2 Account Security

You are responsible for all activities that occur under your account. You must keep your API keys confidential and not share them with unauthorized parties.

4. Acceptable Use

4.1 Permitted Uses

You may use our Services to:

• Protect forms and APIs from automated abuse
• Prevent bot attacks on your websites
• Comply with security requirements

4.2 Prohibited Uses

You may NOT use our Services to:

• Violate any applicable laws or regulations
• Collect personal data beyond what is necessary
• Discriminate against users or block legitimate traffic
• Reverse engineer our detection algorithms
• Circumvent our security measures
• Resell our Services without authorization
• Use the Services for illegal activities

5. Service Tiers and Limits

Exceeding your plan limits may result in service throttling or additional charges.

6. Payment Terms

6.1 Billing

Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by Saudi consumer protection laws.

6.2 Taxes

All fees are exclusive of VAT. Saudi Arabian VAT (15%) will be added where applicable.

6.3 Price Changes

We may change our prices with 30 days notice. Price changes will take effect at the start of your next billing cycle.

7. Intellectual Property

7.1 Our Rights

All rights, title, and interest in the Services, including but not limited to software, algorithms, documentation, and trademarks, remain with GateKeeper.

7.2 Your Rights

You retain all rights to your data. By using our Services, you grant us a license to process your data solely for the purpose of providing the Services.

8. Service Level Agreement

Enterprise customers receive additional SLA guarantees as specified in their service agreement.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:

• Our Services will be error-free or uninterrupted
• All bots will be detected
• No legitimate users will be challenged

We make commercially reasonable efforts to provide accurate bot detection, but false positives and false negatives may occur.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GATEKEEPER SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding fees paid in the 12 months prior to the claim

11. Indemnification

You agree to indemnify and hold harmless GateKeeper from any claims, damages, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

12.1 By You

You may terminate your account at any time through your dashboard. Upon termination, your data will be deleted according to our retention policy.

12.2 By Us

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay fees when due
• Use the Services for illegal purposes

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes shall be resolved in the competent courts of Riyadh, Saudi Arabia.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or dashboard notice at least 30 days before taking effect. Your continued use of the Services after changes take effect constitutes acceptance.
