Terms of Service

1. Agreement to Terms

By accessing or using GateKeeper's CAPTCHA services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Services.

2. Description of Services

GateKeeper provides bot detection and CAPTCHA verification services including:

• Proof-of-Work challenge generation and verification
• Behavioral analysis for bot detection
• Risk scoring API
• Dashboard for site management and analytics

3. Account Registration

3.1 Account Requirements

To use our Services, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

3.2 Account Security

You are responsible for all activities that occur under your account. You must keep your API keys confidential and not share them with unauthorized parties.

4. Acceptable Use

4.1 Permitted Uses

You may use our Services to:

• Protect forms and APIs from automated abuse
• Prevent bot attacks on your websites
• Comply with security requirements

4.2 Prohibited Uses

You may NOT use our Services to:

• Violate any applicable laws or regulations
• Collect personal data beyond what is necessary
• Discriminate against users or block legitimate traffic
• Reverse engineer our detection algorithms
• Circumvent our security measures
• Resell our Services without authorization
• Use the Services for illegal activities
• Remove, hide, or obscure the "Protected by gkCAPTCHA" badge by any means — including CSS, DOM manipulation, proxying, or cropping — in any widget mode, unless your plan includes white-label. Unauthorized badge removal is a violation of these Terms and may result in suspension or termination under Section 12.2.

5. Service Model and Usage

Our Services run on a usage-pool model rather than fixed per-site limits:

• Shared verification pool: your subscription includes a single monthly pool of verifications at the account level, and all of your sites draw from that one pool.
• Unlimited sites: on our self-serve plans you may create and protect as many sites as you need; there is no per-plan cap on the number of sites.
• Optional overage: you may opt in to overage so that protection continues after your monthly pool is used up, with the additional verifications billed at your plan's published overage rate. Overage is off unless you enable it.
• Free trial: trial use is limited to a fixed number of verifications or a fixed period, whichever comes first, as described on the pricing page and in Section 8.

Current pool sizes, prices, and overage rates are published on our pricing page and apply as shown at the time of purchase. We may update these figures from time to time in line with Section 6.3.

6. Payment Terms

6.1 Billing

Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by Saudi consumer protection laws.

6.2 Taxes

All fees are exclusive of VAT. Saudi Arabian VAT (15%) will be added where applicable.

6.3 Price Changes

We may change our prices with 30 days notice. Price changes will take effect at the start of your next billing cycle.

7. Intellectual Property

7.1 Our Rights

All rights, title, and interest in the Services, including but not limited to software, algorithms, documentation, and trademarks, remain with GateKeeper.

7.2 Your Rights

You retain all rights to your data. By using our Services, you grant us a license to process your data solely for the purpose of providing the Services.

8. Service Suspension on Non-Payment / Fail-Open

Protection depends on an active, paid subscription with available usage. When a subscription lapses or a monthly pool is used up without overage enabled, protection for the affected traffic is suspended and that traffic passes through to your site without our verification. We call this "fail-open". This section describes our commercial policy for when this happens; it never reports the live protection state of any individual site.

• Trial ends: when a free trial ends — after its fixed period or its verification allowance, whichever comes first — without an upgrade, protection is suspended and the site's traffic passes through unprotected. No charge applies.
• Paid pool used up, overage off: when a paid monthly pool is fully used and overage is not enabled, protection is suspended and further traffic passes through unprotected until the pool resets or you upgrade. No pool is drawn while traffic is unprotected.
• Paid pool used up, overage on: when overage is enabled, protection continues without interruption after the pool is used up; the additional verifications are billed at your plan's overage rate and you receive a clear notice to raise your cap.
• Per-site sub-limit reached: if you set a per-site sub-limit and a site reaches it, only that site's traffic passes through unprotected; your other sites continue to be protected, and no charge applies for that site.
• Failed renewal charge: if a renewal payment fails, protection continues during a grace and dunning period; suspension applies only after the account enters a lapsed state.
• Mid-period cancellation: if you cancel during a paid period, protection continues until the end of that paid period, after which the lapsed-account terms above apply.

We notify you before protection is suspended, through a dashboard notice and an email.

While traffic passes to your site unprotected, you accept responsibility for that traffic and for any exposure, loss, or damage arising from it. Ending that exposure is your action to take — by paying, upgrading, or enabling overage.

Protection is restored immediately once you pay, upgrade, or enable overage — it takes effect on your next request.

While protection is suspended, a minimal safeguard may still drop clearly automated requests, but this safeguard is limited and is not a substitute for full protection.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:

• Our Services will be error-free or uninterrupted
• All bots will be detected
• No legitimate users will be challenged

We make commercially reasonable efforts to provide accurate bot detection, but false positives and false negatives may occur.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GATEKEEPER SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding fees paid in the 12 months prior to the claim
• Any exposure, loss, or damage arising from traffic that reached your site while protection was suspended under Section 8 (Service Suspension on Non-Payment / Fail-Open), for which you accept responsibility under that section

11. Indemnification

You agree to indemnify and hold harmless GateKeeper from any claims, damages, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

12.1 By You

You may terminate your account at any time through your dashboard. Upon termination, your data will be deleted according to our retention policy.

12.2 By Us

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay fees when due
• Use the Services for illegal purposes

13. Governing Law and Language

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes shall be resolved in the competent courts of Riyadh, Saudi Arabia.

These Terms are published in English and Arabic. The English version is the controlling version: in case of any conflict or inconsistency between the English and Arabic versions, the English version prevails. The Arabic translation is provided for convenience and is pending professional legal review.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or dashboard notice at least 30 days before taking effect. Your continued use of the Services after changes take effect constitutes acceptance.
